STB solicits more input on rate review options

The Surface Transportation Board (STB) announced last week it will permit informal discussions on its proposed rule in Final Offer Rate Review (FORR), Docket No. EP 755, and comments received in that docket regarding arbitration and other rate review options for smaller cases.The board is waiving the general prohibition on ex parte communications in the docket and will permit informal communications with board members and staff between June 1 and July 15, STB officials said in a press release.In September 2019, the board issued a notice of proposed rulemaking and sought public comment on its proposed FORR procedure for challenging the reasonableness of railroad rates in smaller cases. Under the proposal, the board would decide a case by selecting either the complainant's or the defendant's final offer, subject to an expedited procedural schedule that adheres to firm deadlines.The comment period concluded on Jan. 10. After reviewing the record, the board determined it would benefit from additional stakeholder input on the proposal and how to best continue its efforts to establish a new rate review methodology generally.In addition, the comments prompted the board to explore whether its existing arbitration program could be changed to provide a practical alternative dispute resolution mechanism to address smaller rate disputes.Interested parties should contact the board's Office of Public Assistance, Governmental Affairs and Compliance to schedule a meeting via telephone or online conference, STB officials said.

Short Line Safety Institute taps Walsh to oversee hazardous materials programs

The Short Line Safety Institute has hired John Walsh to serve as director of hazardous materials programs.

Walsh has a 30-year career in public safety, security, emergency management, homeland security and compliance, including 15 years in the freight-rail industry. At the institute, he will oversee a new program that evolved from a grant issued by the Pipeline and Hazardous Materials Safety Administration, institute officials said in a press release.

Trinity Metro to receive $55 million in CARES funding

Trinity Metro last week announced it will receive $55 million in federal Coronavirus Aid, Relief, and Economic Security (CARES) Act funding to address the financial impacts of the COVID-19 pandemic. 

Trinity Metro’s $55,161,034 will be used toward offsetting losses in the operating budget from decreased sales tax and fare box revenue. The money also will be used for COVID-19-related expenses incurred to protect passengers and employees, Trinity Metro officials said in a press release.

FRA: Four railroads at risk of missing PTC deadline

The Federal Railroad Administration (FRA) last week released a first-quarter 2020 status report on railroads’ progress in implementing positive train control (PTC) systems as required by Congress. 

As of March 31, 98 percent of the nearly 58,000 route miles subject to the federal mandate were either in revenue service demonstration or in revenue service.

The Chicago Transit Board (CTB) earlier this week approved a measure that allows the Chicago Transit Authority (CTA) to add funding to CTA employee welfare funds to help families pay for funerals of CTA employees who die from COVID-19.

The CTB established the CTA employee welfare fund in 1949 to support employees during times of financial hardship and assists with employee-driven initiatives.

NTSB: Improper warning led to rail worker's death in 2017 LIRR accident

An improperly used train approach warning led to a railroad worker's death after the worker was struck by a train in Queens Village, New York, in 2017, the National Transportation Safety Board (NTSB) announced yesterday in its final report on the incident.

The accident occurred on June 10, 2017, when an MTA Long Island Rail Road (LIRR) train, on track three in multiple track territory, approached a five-member crew of roadway workers in the Queens Interlocking. The foreman and two roadway workers were conducting a walking inspection on Track 1, and were accompanied by the watchman. The fifth worker was clear of the tracks.

First Solar to open distribution hub near South Carolina port

Solar manufacturer First Solar Inc. has selected Greenville, South Carolina, for its new East Coast distribution hub, the South Carolina Ports Authority (SCPA) announced earlier this week.

With its headquarters in Arizona, First Solar operates a photovoltaic model manufacturing footprint in northwest Ohio, as well as factories in Malaysia and Vietnam. The company plans to open a 450,000-square-foot distribution center in Greenville, its first in the Southeast, to warehouse and stage deliveries for U.S. customer, SCPA officials said in a press release.

Caltrain to begin Hillsdale Station reconstruction

Caltrain tomorrow will close the Hillsdale Station in San Mateo, California, for up to six months in order to rebuild it into an elevated station.

When construction is completed, the Hillsdale Station will be relocated about a block north of its current location.

The MTA Long Island Rail Road (LIRR) on May 18 will begin reconstructing what is now the School Street grade crossing in Westbury, New York, into a two-lane grade separated underpass.

Eliminating the crossing will increase safety and reduce noise, air pollution and traffic backups, LIRR officials said in a press release.

SMART’s board is analyzing several strategies to reduce expenses as costs rack up due to the economic impact of the COVID-19 pandemic. Budget reductions being considered include eliminating weekend service, reducing weekday service and suspending free onboard WiFi.

OmniTRAX identifies rail-ready sites along regional's West Virginia line

OmniTRAX Inc. announced yesterday it has extended its Rail-Ready Sites program to the West Virginia branch of the Winchester and Western Railroad Co.OmniTRAX officials worked with the Berkeley County Development Authority in West Virginia to identify developable, rail-ready sites along the railroad. The initial six sites, which total 795 acres and range from 35- to 500-acre parcels, are "ideal" for rail-served manufacturing, food and beverage processing, and distribution facilities, OmniTRAX officials said in a press release.The Rail-Ready Sites program connects rail-served sites with customers in need of property to access rail service."Our team is excited to work with the local experts in Berkeley County to bring new jobs and economic growth to the region," said Ean Johnson, vice president of economic development at OmniTRAX.The county is seeing an industrial resurgence, and the Winchester and Western is "an integral part of that momentum," said Berkeley County Development Authority Executive Director Sandy Hamilton.The Winchester and Western is part of the OmniTRAX organization of short lines and regionals.

New Jersey Transit's board yesterday authorized a $250 million contract for initial construction elements of the Raritan River Bridge replacement project in New Jersey, and a $4.1 million contract for preliminary design of the central concourse extension at Penn Station in New York City.

The board approved a contract with George Harms Construction Co. Inc. to construct bridge approach spans, lift bridge and flanking spans piers and perform associated land work for the first phase of construction of the Raritan River bridge replacement project.

BNSF advances bridge projects in Idaho, Washington

Work is advancing on two BNSF Railway Co. bridges this spring, one near Sandpoint, Idaho, and the other over Drano Lake in Skamania County, Washington.

BNSF is continuing work on a temporary rail bridge over Lake Pend Oreille near Sandpoint. Construction crews are building a second rail bridge adjacent to the existing rail bridge, and are currently working on a temporary span. That span will be taller than the eventual permanent bridge, which will be the same height as the existing bridge that BNSF is replacing, BNSF officials said in a recent company newsletter.
