STB: Five Class Is were 'revenue adequate' in 2019

The Surface Transportation Board (STB) announced yesterday that BNSF Railway Co., CSX, Norfolk Southern Railway's combined subsidiaries, Canadian Pacific's Soo Line Corp. and Union Pacific Railroad achieved "revenue adequacy" in 2019.A railroad is considered to be revenue adequate if it achieves a rate of return on net investment equal to at least the current cost of capital for the railroad industry in a given year. Congress directs the STB to conduct revenue adequacy determinations every year.For 2019, the board determined the rate of return figure to be 9.34 percent. The five Class Is' rate of return exceeded the STB's calculation of the industry's cost of capital.Meanwhile, the board also announced it is seeking public comments on a proposed approach developed by the STB's Office of Economics for possible use in considering class exemption and revocation issues. The office developed the new approach to help the STB evaluate market conditions using a variety of metrics related to rail competition.The new approach would serve as a potential tool for evaluating market conditions governing a commodity, including changes in conditions over time. However, they would not serve as a mechanical test for determining whether the commodity exemptions at issue should be revoked or whether a new exemption should be issued, STB officials said in a press release.Initial comments on the new approach are due to the board by Dec. 4 and replies to initial comments are due by Jan. 4, 2021.

Caltrain this month will begin a 14-month project to improve the Napoleon Street and Marin Street bridges in San Francisco. 

The Napoleon Street Bridge will be replaced for safety and structural integrity purposes. Caltrain crews will replace four short bridge spans with a center steel bridge. The new bridge will also feature steel girders and new wing walls.

Metra wraps up rail-car shop expansion

Metra yesterday completed a $32.5 million project to renovate and expand the agency's 47th Street and 49th Street rail car and locomotive repair facilities in Chicago.

The expanded 49th Street facility includes a new 38,000-square-foot building with a classroom space, workshop and welding training area. The facility also includes an upgraded loading dock, storage and rail-car wheel truck rebuild area.

BNSF marks first year at Denver-area logistics center

BNSF Railway Co. yesterday marked the first anniversary of its Logistics Center Hudson receiving its first unit train of sand.

Construction began on the rail-served development, located in the greater Denver area, in February 2019. The center served its first customer, Granite Peak Transloading, seven months later.

Amtrak cancels Winter Park Express for 2020-21 season

Amtrak has suspended the Winter Park Express service between Denver’s Union Station and the Winter Park Resort in Winter Park, Colorado, until winter 2022. 

Amtrak has been reducing the number of seats sold on each train to enable distancing. Amtrak and Winter Park Resort officials evaluated seating options on the route and agreed that, with the social distancing requirements, it was not possible to operate the train successfully this season, Amtrak officials said in a press release.

U.S., Canadian railroads' intermodal volume rose in Week 39

U.S. freight-rail traffic declined 2.1 percent to 518,290 carloads and intermodal units during the week ending Sept. 26 compared with the same week in a year ago, according to Association of American Railroads (AAR).

Railroads hauled 224,146 carloads during the week, a 10.5 percent year-over-year decrease. But intermodal volume climbed 5.5 percent to 294,144 containers and trailers, AAR officials said in a press release.

The Regional Transportation District of Denver’s (RTD) board finalized a five-year contract with Debra Johnson as the agency’s next general manager and chief executive officer. She will assume the role on Nov. 9. 

The contract terms include an annual salary of $315,000, with cost of living adjustments and potential incentive awards and increases tied to performance goals, RTD officials said in a press release.

CN, Wisconsin town resolve dispute over future autoport site

The Wisconsin Office of the Commissioner of Railroads (OCR) has issued an order that resolves a dispute between CN's Wisconsin Central Ltd. (WCL) line and the town of Richmond in St. Croix County over the railroad's plan for a new autoport and intermodal shipping facility in the area.

Issued Sept. 14, the OCR's order calls for the town to relocate 105th Street to avoid establishing a new crossing of proposed siding tracks with 105th Street at its current location.

Trump signs bill to avert government shutdown, extends FAST Act by a year

Congress yesterday passed and President Donald Trump last night signed legislation to prevent a government shutdown by continuing to fund federal programs at current levels through Dec. 11.The Continuing Resolution Appropriations Act (H.R. 8337) also extends the Fixing America's Surface Transportation (FAST) Act for one year, and ensures the Mass Transit Account in the federal Highway Trust Fund will remain solvent during that period, American Public Transportation Association (APTA) officials said in a press release.The Mass Transit Account funds public transit agencies. The FAST Act was scheduled to expire yesterday. The bill signed yesterday is the first time in 30 years that Congress enacted a one-year extension of surface transportation authorization programs after the lapse of a multiyear authorization act, APTA officials said.The FAST Act extension provides at least $12.6 billion for public transit investment and prevents a $6 billion across-the-board cut to public transit agencies, they said. The legislation provides $3.2 billion to the Mass Transit Account."While passage of this bill is vital to the industry, Congress still needs to address the urgent and dire situation faced by public transportation systems across the nation," said APTA President and Chief Executive Officer Paul Skoutelas. "As Congress negotiates the newly proposed Heroes Act, APTA implores both chambers of Congress and the administration to provide at least $32 billion in critical federal support to enable the public transit industry to survive this unprecedented pandemic."

Wabtec Corp. formed a partnership with Penn State University to conduct energy management, battery technology and machine learning research, as well as facilitate professional and talent development. The partnership gives Wabtec access to a research institution with the resources to bring new innovations to the market, Wabtec officials said in a press release. The arrangement is "a model for how universities and corporations can successfully work together to solve real-world challenges,” said Melissa Erekson, assistant vice president of corporate engagement at Penn State. The partnership builds upon years of collaboration between the university and the company.

Icomera UK completed the acquisition of London-based GoMedia Services Ltd. GoMedia is a provider of onboard infotainment for public transport, including passenger information and customer messaging. The acquisition enables Icomera parent company ENGIE Solutions to deliver an end-to-end passenger information and entertainment offering to transport operators, Icomera officials said in a press release. Meanwhile, Metrolinx  launched its first GO Transit trains equipped with Icomera’s centralized connectivity network platform. The solution will allow Metrolinx riders access to the internet and other passenger, operational and safety applications.

Indiana DOT to update state rail plan

The Indiana Department of Transportation (INDOT) is asking the public and stakeholders to help update the state's rail plan by weighing in on the future of passenger- and freight-rail service.Last updated in 2017, the plan helps guide the improvement of freight- and passenger-rail systems in rural and urban areas throughout the state, INDOT officials said in a press release.Federal law requires the plan to be updated every four years.The procedures will include an online survey, which will be available to the general public in early fall; a committee of rail industry representatives to meet next month, as well as in February and May 2021; and one-on-one interviews to be held starting this month and through April 21 with select Indiana shippers and freight trade organizations.The process will be conducted via virtual and phone outreach, INDOT officials said.

The Los Angeles County Metropolitan Transportation Authority's (LA Metro) board last week approved a sustainability plan that outlines the agency’s strategy to reduce air pollution, smog and greenhouse gases (GHG) across Los Angeles County. 

The Moving Beyond Sustainability (MBS) plan calls for tripling LA Metro’s on-site renewable energy generation by 2030, reducing total GHG emissions by 79 percent from 2017 levels and reducing total nitrogen oxides emissions by 54 percent.

Bay Area Rapid Transit (BART) earlier this week released a request for expressions of interest (RFEI) seeking input from firms to assist the agency in developing its next generation of fare gates.

The RFEI is designed to help assess the potential benefits, challenges and the feasibility of alternatives for BART’s fare gate upgrade project to replace 715 gates with new technology to improve the rider experience and reduce fare evasion, BART officials said in a press release.

NOW, which interchanges with Norfolk Southern Railway and CSX, currently works with customers in the industrial and manufacturing sectors, as well as producers of limestone, lime and pressed board, OmniTRAX officials said in a press release.The Interstate-75 corridor in northwestern Ohio is "bustling" due to its proximity to major markets and infrastructure, said Ean Johnson, vice president of industrial development at OmniTRAX."The sites we've identified with the Tiffin-Seneca Economic Partnership take advantage of these benefits and the area's growing industrial base provides great product for attracting new industries," Johnson said.

Unionized Amtrak workers, led by rail labor organizations, today will rally in Washington, D.C., New York City, Chicago and Los Angeles to urge members of Congress to provide emergency funding to Amtrak to prevent planned cuts to service and its workforce. 

Earlier this month, Amtrak President and Chief Executive Officer William Flynn called for $5 billion in emergency funding to deal with the effects of the COVID-19 pandemic. If no additional funding is provided by the federal government, Amtrak has announced impending cuts, effective Oct. 1, of 1,950 unionized employees and a planned reduction of service.

Norfolk Southern Railway yesterday recognized 58 chemical shippers who earned the company's 2019 Thoroughbred Chemical Safety Award for safely handling products regulated as hazardous materials.The companies safely shipped at least 1,000 carloads — and a combined total of more than 284,000 carloads — over the Class I's rail network without a single incident in 2019, NS officials said in a press release."We greatly appreciate our customers' shared commitment to safety as we work together to deliver the goods that are essential to households and businesses across America," said NS Chairman, President and Chief Executive Officer James Squires. STB rejects Metra's request for declaratory order in dispute with UP

The Surface Transportation Board (STB) last week denied Metra's request for a declaratory order and a petition for preliminary injunction on issues related to its ongoing dispute with Union Pacific Railroad over Chicago-area commuter-rail service.The STB declined to issue the declaratory order on issues already pending before a district court that declined to refer those issues to the board. In July, Metra filed the petition for declaratory order and a petition for preliminary injunction related to its purchase-of-service agreement (PSA) with UP, which was set to expire Aug. 31. UP owns three lines in the Metra system and has operated those lines under the PSA. Early this summer, UP advised Metra that it would begin to phase out various services provided under the PSA.Metra asked the STB to issue the declaratory order that UP has a continuing common carrier obligation to provide commuter service. The two sides also have been engaged in a lawsuit over the matter, and Metra has tried to get the court case dismiss and convince the STB to handle the railroads' dispute.The STB's Sept. 25 ruling follows a U.S. District Court's decision to keep the UP lawsuit against Metra, noting that the court does have jurisdiction over contract disputes.
